Economics of Intellectual Property - Cadbury and the Colour Purple

An interesting example here of what constitutes intellectual property rights - in this case, Cadbury have lost a legal battle over the specific shade of purple that it uses on its wrappers - Pantone 2865c.

The courts have ruled that Cadbury's don't have any exclusive right to use that colour, excluding everyone else. Could this be a prelude to existing rivals and perhaps challenger brands treading on Cadbury's turf with chocolate of a similar colour?
