Psychology In The News | The Psychology of Video Evidence

Imagine you and a friend watch the same video: a police chase, an argument, a protest and walk away with completely different views of what happened. This might sound very unlikely, but it is entirely possible and has real consequences in courtrooms around the world. A landmark US Supreme Court case, Scott v. Harris (2007), centred on dashboard camera footage of a police chase. What makes this case so psychologically fascinating is that multiple judges across different courts, and even within the Supreme Court itself, watched the same footage and reached completely different conclusions about what it showed. As Sandra Ristovska from the University of Colorado puts it, 'seeing is not just what our eyes physically see' it is shaped by our experiences, beliefs, and biases.’ So, what is going on in our brains?

Psychologists have identified several effects. The slow-motion bias shows that footage played in slow motion makes a suspect appear more intentional in their actions. Furthermore, camera perspective bias means that focusing the camera on a suspect's face (rather than the interviewer) leads viewers to judge a confession as more voluntary. These biases can profoundly affect how justice is applied.

Memory itself is also unreliable. Elizabeth Loftus, whose research you may recognise from your studies on eyewitness testimony, reminds us that memory is reconstructive, not like pressing play on a recording. Eyewitnesses can even ‘contaminate’ each other's memories simply by discussing what they saw, absorbing each other's details without realising it. This is especially relevant if witnesses later view video footage, which can overwrite or distort their original memories.

Perhaps most worryingly, people tend to trust video almost unconditionally: even when they know it has been manipulated. With AI now capable of subtly altering footage and implanting false memories of images people never saw, the implications for psychology, law, and society are enormous. The human mind is far less objective than we like to believe.
