Cracking case here which shows how far back some common law principles go. The case concerns squatters' rights (adverse possession), and whether a claim for title made this way is affected by s144 of the Legal Aid, Sentencing and Punishment of Offenders Act 2012, which criminalises squatting.The High Court judge makes an interesting decision in favour of the squatter. Which approach to statutory interpretation does he adopt? It will be interesting to note the outcome of this case following the seemingly inevitable appeal.
